1. Identification of the service provider
The electronic invoicing service accessible through the Website facturovia.com under the commercial name Facturovia is provided by a self-employed professional registered in Spain. The complete identification of the service provider, in compliance with Article 10 of Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI-CE), is available in the Legal Notice accessible from the Website. The contact channel established for any communication relating to the service, including contractual relations and user queries, is the email address info@facturovia.com. These General Terms of Use govern the contractual relationship between the service provider and users who access, browse, or use the Website and the service associated with it.
2. Service description
Facturovia is a SaaS (Software as a Service) invoicing platform designed for freelancers and SMEs in Spain. The service allows you to create, manage and issue invoices and quotes, manage clients, generate custom PDFs, export data and other functionalities described on the plans page. We are working on VeriFactu integration (Royal Decree 1007/2023 and Order HAC/1177/2024), mandatory from 2027, and will communicate its availability when operational.
3. Account registration
To use the service, you must create an account providing accurate and up-to-date information, including your Spanish tax ID (NIF/CIF/NIE), name or company name, fiscal address, and email address. You are responsible for maintaining the confidentiality of your login credentials and all activities that occur under your account. Any unauthorized use must be reported immediately to info@facturovia.com.
4. Plans, pricing and billing
Facturovia offers three subscription plans: Basic Plan, at a price of €4.99 per month (VAT not included), with a combined limit of twenty (20) invoices and quotes per month; Professional Plan, at a price of €9.99 per month (VAT not included), with unlimited issuance of invoices and quotes; and Business Plan, at a price of €29.99 per month (VAT not included), with unlimited issuance of invoices and quotes, as well as additional features such as multi-user access, permission management and API access. All plans include a free trial period extending until the end of the first full natural month after the account registration date. For example, a user who registers on March 15 will have a free trial until April 30 inclusive; a user who registers on March 1 will have the same period. During this period the user may access all functionalities of the chosen plan at no cost. A payment method is not required to start the trial period. After this period, if the user does not enter a valid payment method and complete the subscription, the account will remain active but limited to consultation of previously entered data, without the possibility of issuing new invoices or quotes until the subscription is completed. The user may reactivate the account at any time by entering a valid payment method. Subscriptions are billed monthly and in advance via the payment method provided when activating the account. Prices may be modified with a minimum notice of thirty (30) days by email.
5. Cancellation and refund policy
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period, with no penalty or lock-in contract. No refunds are made for partial periods already billed. If you cancel during the free trial, you will not be charged.
6. User obligations
You agree to use the service in a lawful manner and in compliance with applicable regulations, particularly Spanish tax law. It is expressly prohibited to use the service to issue fraudulent, false, or non-compliant invoices, or to engage in any activity that violates third-party rights or applicable law.
7. Limitation of liability
Facturovia is provided 'as is' without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted or error-free. We shall not be liable for indirect, incidental, special or consequential damages arising from the use or inability to use the service. Our total maximum liability is limited to the amount paid by you in the three months prior to the event giving rise to the claim.
8. Intellectual property
All intellectual property rights in the software, design, logos and content of the platform belong to Facturovia or its licensors. You receive a limited, non-exclusive, non-transferable licence to use the service under these terms. Reproduction, distribution, modification or reverse engineering of the software is prohibited.
9. Data protection
The processing of your personal data is governed by the Facturovia Privacy Policy, available at facturovia.com/privacy, in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 on Personal Data Protection and Digital Rights Guarantee (LOPDGDD).
10. Governing law and jurisdiction
These Terms and Conditions are governed entirely by Spanish law. For the resolution of any dispute arising from the contractual relationship, the parties submit, with express waiver of any other jurisdiction, to the Courts and Tribunals of Spain.
